Nj\u00ebri prej operator\u00ebve njoftoi se do ta ushtroj\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb p\u00ebr t\u00eb gjith\u00eb p\u00ebrdoruesit celular\u00eb, duke filluar nga muaji maj. Nj\u00eb praktik\u00eb e till\u00eb ka shtuar shqet\u00ebsimet p\u00ebr rritjen e vazhdueshme t\u00eb kostove t\u00eb komunikimit.<\/p>\n<p>Muajin e kaluar, nj\u00eb nga operator\u00ebt celular\u00eb njoftoi p\u00ebrdoruesit p\u00ebr rritjen e \u00e7mimeve t\u00eb sh\u00ebrbimeve celulare, n\u00ebp\u00ebrmjet indeksimit me ndryshimin mesatar vjetor t\u00eb \u00e7mimeve t\u00eb konsumit, duke nisur nga data 1 maj 2026.<\/p>\n<p>Rritja e \u00e7mimeve do t\u00eb jet\u00eb deri n\u00eb mas\u00ebn 2.2%, sipas norm\u00ebs s\u00eb inflacionit mesatar vjetor t\u00eb publikuar nga INSTAT p\u00ebr vitin 2025.<\/p>\n<p>Praktika e indeksimit t\u00eb tarifave me inflacionin e ka origjin\u00ebn n\u00eb vitin 2024, kur dy operator\u00ebt m\u00eb t\u00eb m\u00ebdhenj t\u00eb komunikimeve elektronike n\u00eb vend, Vodafone Albania dhe One Albania, pat\u00ebn njoftuar ndryshime n\u00eb termat dhe kushtet e p\u00ebrgjithshme p\u00ebr sh\u00ebrbimet e rrjetit celular dhe rrjetit fiks t\u00eb kategorive Konsumator dhe Biznes, duke vendosur nj\u00eb klauzol\u00eb t\u00eb ve\u00e7ant\u00eb, ku rezervonin t\u00eb drejt\u00ebn p\u00ebr t\u00eb indeksuar \u00e7mimet e sh\u00ebrbimeve t\u00eb tyre me norm\u00ebn e inflacionit t\u00eb vitit t\u00eb m\u00ebparsh\u00ebm.<\/p>\n<p>Mb\u00ebshtetur n\u00eb informacionin e deritanish\u00ebm nga AKEP, kjo klauzol\u00eb ishte aplikuar p\u00ebr her\u00eb t\u00eb par\u00eb vet\u00ebm nga One Albania, duke filluar nga data 1 qershor 2024, por vet\u00ebm p\u00ebr pajtimtar\u00ebt e kategoris\u00eb Biznes.<\/p>\n<p>Megjith\u00ebse rritja e \u00e7mimeve n\u00eb vetvete, n\u00eb rastin konkret, mund t\u00eb mos jet\u00eb shum\u00eb e madhe, aplikimi i nj\u00eb praktike t\u00eb till\u00eb shton shqet\u00ebsimin p\u00ebr efektin afatgjat\u00eb q\u00eb ajo mund t\u00eb ket\u00eb n\u00eb koh\u00eb. Nj\u00eb indeksim i p\u00ebrvitsh\u00ebm, p\u00ebr m\u00eb tep\u00ebr n\u00eb periudha kur inflacioni mund t\u00eb jet\u00eb ndjesh\u00ebm m\u00eb i lart\u00eb, do t\u00eb sillte shtrenjtim progresiv t\u00eb kostove t\u00eb komunikimit p\u00ebr p\u00ebrdoruesit shqiptar\u00eb.<\/p>\n<p>Nuk \u00ebsht\u00eb rast\u00ebsi q\u00eb operator\u00ebt celular\u00eb po e aplikojn\u00eb indeksimin vet\u00ebm n\u00eb segmentin e sh\u00ebrbimeve celulare, ku konkurrenca \u00ebsht\u00eb e kufizuar dhe n\u00eb kushtet e nj\u00eb duopoli.<\/p>\n<p>Nj\u00eb veprim i till\u00eb deri tani, nuk \u00ebsht\u00eb nd\u00ebrmarr\u00eb n\u00eb segmentin e sh\u00ebrbimeve fikse t\u00eb t\u00eb dy operator\u00ebve, p\u00ebr arsyen e thjesht\u00eb se tregu i sh\u00ebrbimeve fikse t\u00eb komunikimit ka m\u00eb shum\u00eb konkurrenc\u00eb dhe p\u00ebrdoruesit kan\u00eb m\u00eb shum\u00eb zgjedhje p\u00ebr t\u2019u larguar drejt nj\u00eb ofruesi tjet\u00ebr sh\u00ebrbimi.<\/p>\n<p>Indeksimi i \u00e7mimeve me inflacionin nuk duket t\u00eb jet\u00eb plot\u00ebsisht i bazuar as nga pik\u00ebpamja teorike, sepse ndryshimi vjetor i inflacionit nuk reflektohet domosdoshm\u00ebrisht n\u00eb mas\u00eb t\u00eb plot\u00eb n\u00eb struktur\u00ebn e kostove t\u00eb operator\u00ebve.<\/p>\n<p>P\u00ebrkundrazi, n\u00eb pjes\u00ebn m\u00eb t\u00eb madhe, shpenzimet e operator\u00ebve lidhen me z\u00ebra q\u00eb nuk reflektojn\u00eb n\u00eb m\u00ebnyr\u00eb proporcionale shport\u00ebn e indeksit t\u00eb \u00e7mimeve t\u00eb konsumit.<\/p>\n<p><strong>Autoriteti i Konkurrenc\u00ebs: Indeksimi \u00ebsht\u00eb element i hetimit ndaj operator\u00ebve<\/strong><\/p>\n<p>\u201cMonitor\u201d iu drejtua me nj\u00eb k\u00ebrkes\u00eb zyrtare Autoritetit t\u00eb Konkurrenc\u00ebs, p\u00ebr t\u00eb marr\u00eb nj\u00eb q\u00ebndrim nga ky institucion p\u00ebr faktin n\u00ebse praktika e indeksimit automatik t\u00eb \u00e7mimeve t\u00eb sh\u00ebrbimeve t\u00eb komunikimeve elektronike shtron probleme q\u00eb lidhen me t\u00eb drejt\u00ebn e konkurrenc\u00ebs.<\/p>\n<p>N\u00eb p\u00ebrgjigjen p\u00ebr \u201cMonitor\u201d, Autoriteti i Konkurrenc\u00ebs shprehet se kjo \u00e7\u00ebshtje \u00ebsht\u00eb nga elementet e hetimit t\u00eb thelluar q\u00eb ky institucion ka hapur n\u00eb tregun me pakic\u00eb t\u00eb sh\u00ebrbimeve celulare, n\u00eb n\u00ebntor t\u00eb vitit t\u00eb kaluar.<\/p>\n<p>N\u00eb pikat 8 dhe 9 t\u00eb k\u00ebtij vendimi trajtohet edhe \u00e7\u00ebshtja e aplikimit t\u00eb Indeksit t\u00eb \u00c7mimeve t\u00eb Konsumit (I\u00c7K), konkretisht:<\/p>\n<p>Sipas kontrat\u00ebs s\u00eb pajtimit t\u00eb nd\u00ebrmarrjes Vodafone Albania SHA (\u201cTermat dhe Kushtet e P\u00ebrgjithshme p\u00ebr sh\u00ebrbimet e telefonis\u00eb s\u00eb l\u00ebvizshme\u201d), parashikohet q\u00eb detyrimet e pajtimtarit p\u00ebr pages\u00ebn e tarifave mund t\u2019u n\u00ebnshtrohen rregullimeve jo m\u00eb shum\u00eb se nj\u00eb her\u00eb n\u00eb vit, ku \u00e7do muaj prill, vlera mujore e planit tarifor dhe e paketave rritet n\u00eb p\u00ebrputhje me norm\u00ebn e I\u00c7K t\u00eb publikuar nga INSTAT.<\/p>\n<p>Nd\u00ebrmarrja One Albania ka njoftuar p\u00ebr p\u00ebrdit\u00ebsimin e termave dhe kushteve t\u00eb kontratave,<\/p>\n<p>duke p\u00ebrfshir\u00eb nj\u00eb klauzol\u00eb mbi indeksimin e \u00e7mimeve t\u00eb pajtimtar\u00ebve n\u00eb p\u00ebrputhje me I\u00c7K, t\u00eb<\/p>\n<p>publikuar zyrtarisht nga INSTAT.<\/p>\n<p>\u201cN\u00eb k\u00ebt\u00eb kuad\u00ebr, b\u00ebjm\u00eb t\u00eb ditur se gjat\u00eb procedur\u00ebs s\u00eb hetimit t\u00eb thelluar n\u00eb tregun me pakic\u00eb t\u00eb<\/p>\n<p>sh\u00ebrbimeve celulare, Sekretariati i Autoritetit t\u00eb Konkurrenc\u00ebs do t\u00eb vler\u00ebsoj\u00eb edhe aplikimin e norm\u00ebs s\u00eb I\u00c7K, n\u00eb kuptim t\u00eb dispozitave t\u00eb Ligjit nr. 9121, dat\u00eb 28.07.2003 \u2018P\u00ebr mbrojtjen e konkurrenc\u00ebs\u2019. Procedura e hetimit \u00ebsht\u00eb aktualisht n\u00eb vijim\u201d, thuhet n\u00eb p\u00ebrgjigjen e Autoritetit t\u00eb Konkurrenc\u00ebs.<\/p>\n<p><strong>Trupa e Rregullator\u00ebve t\u00eb BE-s\u00eb: Klauzolat e indeksimit cenojn\u00eb t\u00eb drejtat e konsumator\u00ebve<\/strong><\/p>\n<p>P\u00ebrcaktimi i nj\u00eb klauzole q\u00eb u lejon operator\u00ebve t\u00eb indeksojn\u00eb automatikisht tarifat e produkteve dhe sh\u00ebrbimeve me inflacionin ngelet \u00e7\u00ebshtje e diskutueshme nga pik\u00ebpamja ligjore, jo vet\u00ebm n\u00eb Shqip\u00ebri, por edhe n\u00eb Bashkimin Europian.<\/p>\n<p>Autoriteti i Komunikimeve Elektronike dhe Postare (AKEP) ka mbledhur informacion mbi legjislacionin e vendeve t\u00eb tjera, lidhur me nj\u00eb dispozit\u00eb t\u00eb till\u00eb. Nga informacioni i mbledhur ka rezultuar se, p\u00ebrgjith\u00ebsisht, e drejta p\u00ebr indeksim me norm\u00ebn e inflacionit nuk \u00ebsht\u00eb e ndaluar n\u00eb legjislacionin specifik sektorial apo n\u00eb at\u00eb t\u00eb p\u00ebrgjithsh\u00ebm.<\/p>\n<p>N\u00eb kushtet kur nuk ekziston nj\u00eb ndalim eksplicit, AKEP l\u00eb t\u00eb kuptohet se praktika e indeksimit t\u00eb tarifave \u00ebsht\u00eb nj\u00eb praktik\u00eb q\u00eb mund t\u00eb konsiderohet e lejuar ligj\u00ebrisht.<\/p>\n<p>Por, nj\u00eb kuad\u00ebr i ndrysh\u00ebm ligjor ekziston n\u00eb Angli, ku autoriteti rregullator (OFCOM) ka vendosur rregulla dhe ka dh\u00ebn\u00eb udh\u00ebzime p\u00ebr rastet kur dhe si operator\u00ebt mund t\u00eb p\u00ebrfshijn\u00eb indeksimin n\u00eb termat dhe kushtet e p\u00ebrgjithshme t\u00eb kontrat\u00ebs.<\/p>\n<p>OFCOM ka kryer nj\u00eb proces K\u00ebshillimi Publik n\u00eb lidhje me k\u00ebt\u00eb \u00e7\u00ebshtje dhe ka miratuar gjat\u00eb vitit 2024 ndryshime n\u00eb kuadrin rregullator, t\u00eb cilat ndalojn\u00eb aplikimin e rritjes s\u00eb tarifave t\u00eb shprehura n\u00eb p\u00ebrqindje (I\u00c7K), ku rritjet gjat\u00eb koh\u00ebzgjatjes s\u00eb kontrat\u00ebs duhet t\u00eb shprehen n\u00eb terma monetar\u00eb.<\/p>\n<p>Megjithat\u00eb, nj\u00eb q\u00ebndrim kund\u00ebr nj\u00eb praktike t\u00eb till\u00eb ka shprehur autoriteti kryesor n\u00eb rregullimin e k\u00ebtyre tregjeve, Trupa e Rregullator\u00ebve Europian\u00eb t\u00eb Komunikimeve Elektronike (BEREC).<\/p>\n<p>N\u00eb nj\u00eb dokument t\u00eb vitit 2024, t\u00eb quajtur \u201cOpinioni i BEREC mbi tregun dhe zhvillimet teknologjike dhe mbi ndikimin e tyre n\u00eb zbatimin e t\u00eb drejtave t\u00eb p\u00ebrdoruesve fundor\u00eb\u201d, i publikuar n\u00eb dhjetor 2024, kjo trup\u00eb e ka konsideruar p\u00ebrfshirjen dhe aplikimin nga operator\u00ebt n\u00eb vendet e BE-s\u00eb t\u00eb klauzolave kontraktore p\u00ebr rritje t\u00eb \u00e7mimeve gjat\u00eb koh\u00ebzgjatjes s\u00eb kontrat\u00ebs (In-contract price increase clauses) sipas I\u00c7K apo I\u00c7K plus nj\u00eb marzh, si \u201czhvillim me ndikim shqet\u00ebsues p\u00ebr t\u00eb drejtat dhe p\u00ebrfitimet e p\u00ebrdoruesve fundor\u00eb, pasi n\u00eb disa raste, ato kan\u00eb rezultuar n\u00eb rritje t\u00eb ndjeshme t\u00eb tarifave dhe\/ose p\u00ebrdoruesit nuk kan\u00eb t\u00eb drejt\u00ebn e nd\u00ebrprerjes pa penalitet t\u00eb kontrat\u00ebs\u201d.<\/p>\n<p>Opinioni dhe propozimi i BEREC p\u00ebr Komisionin Europian p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje \u00ebsht\u00eb se<\/p>\n<p>\u201ck\u00ebto klauzola paraqesin sfida p\u00ebr sa i p\u00ebrket konkurrenc\u00ebs, p\u00ebrballueshm\u00ebris\u00eb, l\u00ebvizshm\u00ebris\u00eb<\/p>\n<p>(nd\u00ebrrimit t\u00eb ofruesit s\u00eb sh\u00ebrbimit) s\u00eb p\u00ebrdoruesit fundor, transparenc\u00ebs dhe krahasueshm\u00ebris\u00eb s\u00eb<\/p>\n<p>\u00e7mimeve. P\u00ebrdorimi i tyre krijon rrezik q\u00eb objektivat e kuadrit ligjor p\u00ebr mbrojtjen e konsumator\u00ebve t\u00eb mos p\u00ebrmbushen\u201d.<\/p>\n<p>Pavar\u00ebsisht k\u00ebtyre rekomandimeve, deri tani, AKEP nuk ka shprehur ndonj\u00eb q\u00ebllim t\u00eb nd\u00ebrhyj\u00eb p\u00ebr t\u00eb rregulluar apo p\u00ebr t\u00eb ndaluar klauzola t\u00eb k\u00ebtij lloji nga operator\u00ebt e komunikimeve elektronike n\u00eb Shqip\u00ebri.<\/p>\n<p><strong>Operator\u00ebt: Praktik\u00eb e ligjshme, lejohet edhe n\u00eb BE<\/strong><\/p>\n<p>Dy operator\u00ebt e komunikimeve elektronike n\u00eb vend kan\u00eb argumentuar pran\u00eb rregullatorit se nj\u00eb klauzol\u00eb q\u00eb u lejon indeksimin e tarifave \u00ebsht\u00eb e ligjshme, madje kan\u00eb dh\u00ebn\u00eb shembuj t\u00eb aplikimit t\u00eb k\u00ebsaj klauzole n\u00eb nj\u00eb s\u00ebr\u00eb vendesh t\u00eb BE-s\u00eb, p\u00ebrfshir\u00eb operator\u00eb t\u00eb tjer\u00eb, pjes\u00eb e grupeve t\u00eb kompanive pronare t\u00eb dy sip\u00ebrmarr\u00ebsve.<\/p>\n<p>Gjithashtu, operator\u00ebt celular\u00eb kan\u00eb sjell\u00eb si shembull edhe nj\u00eb precedent nga praktika gjyq\u00ebsore e BE-s\u00eb.<\/p>\n<p>Ata kan\u00eb mb\u00ebshtetur q\u00ebndrimin e tyre me nj\u00eb vendim t\u00eb Gjykat\u00ebs Europiane t\u00eb Drejt\u00ebsis\u00eb, t\u00eb dat\u00ebs 26.12.2015, n\u00eb \u00e7\u00ebshtjen q\u00eb kishte p\u00ebrball\u00eb nj\u00eb shoqat\u00eb t\u00eb mbrojtjes s\u00eb konsumator\u00ebve n\u00eb Austri dhe nj\u00ebrin prej operator\u00ebve t\u00eb komunikimeve elektronike n\u00eb vend (Verein f\u00fcr Konsumenteninformation vs A1 Telekom Austria).<\/p>\n<p>Me k\u00ebt\u00eb vendim, Gjykata i dha t\u00eb drejt\u00eb operatorit, me interpretimin se nj\u00eb ndryshim n\u00eb tarifa, q\u00eb vjen si rezultat i nj\u00eb klauzole t\u00eb axhustimit t\u00eb \u00e7mimit t\u00eb p\u00ebrfshir\u00eb n\u00eb termat dhe kushtet standarde t\u00eb kontrat\u00ebs, e cila parashikon q\u00eb ky ndryshim \u00ebsht\u00eb i bazuar n\u00eb ndryshimet q\u00eb p\u00ebson indeksi i \u00e7mimeve t\u00eb konsumit t\u00eb hartuar nga nj\u00eb institucion publik, nuk p\u00ebrb\u00ebn modifikim t\u00eb kushteve kontraktuale dhe nuk i jep t\u00eb drejt\u00ebn pajtimtarit t\u00eb nd\u00ebrpres\u00eb kontrat\u00ebn pa penalitet.<\/p>\n<p><strong>Shpenzimi mesatar celular, n\u00eb rritje prej kat\u00ebr vitesh radhazi<\/strong><\/p>\n<p>Shpenzimi mesatar i shqiptar\u00ebve p\u00ebr sh\u00ebrbime t\u00eb komunikimeve celulare u rrit p\u00ebr t\u00eb kat\u00ebrtin vit radhazi n\u00eb 2024.<\/p>\n<p>Sipas t\u00eb dh\u00ebnave nga Autoriteti i Komunikimeve Elektronike dhe Postare (AKEP), shpenzimi mesatar arriti n\u00eb 9200 lek\u00eb n\u00eb vit, 16% m\u00eb shum\u00eb krahasuar me nj\u00eb vit m\u00eb par\u00eb. Kjo vler\u00eb mb\u00ebshtetet n\u00eb treguesin e t\u00eb ardhurave mesatare p\u00ebr p\u00ebrdorues t\u00eb operator\u00ebve celular\u00eb (ARPU) dhe llogaritet si raport i t\u00eb ardhurave nga sh\u00ebrbimet me pakic\u00eb me numrin total t\u00eb p\u00ebrdoruesve aktiv\u00eb.<\/p>\n<p>Gjithashtu, shpenzimi mesatar i shqiptar\u00ebve p\u00ebr \u00e7do minut\u00eb thirrje celulare n\u00eb vitin 2024 u rrit n\u00eb 5.54 lek\u00eb p\u00ebr minut\u00eb, n\u00eb rritje me 16% krahasuar me nj\u00eb vit m\u00eb par\u00eb. Kjo vler\u00eb bazohet n\u00eb treguesin e t\u00eb ardhurave mesatare p\u00ebr minut\u00eb (ARPM), q\u00eb llogaritet si raport i t\u00eb ardhurave nga sh\u00ebrbimet me pakic\u00eb me sasin\u00eb e minutave dal\u00ebse dhe tregon t\u00eb ardhurat e sip\u00ebrmarr\u00ebsit p\u00ebr nj\u00eb minut\u00eb.<\/p>\n<p>Dy operator\u00ebt e rrjeteve celulare, Vodafone Albania dhe One Albania, vitin e kaluar raportuan t\u00eb ardhura prej komunikimeve elektronike n\u00eb vler\u00ebn 27.9 miliard\u00eb lek\u00eb, n\u00eb rritje me 8.9% krahasuar me nj\u00eb vit m\u00eb par\u00eb.<\/p>\n<p>N\u00eb ndarjen e tregut sipas xhiros s\u00eb gjeneruar nga segmenti celular, Vodafone Albania ka thelluar dominimin e vet, me rreth 58% t\u00eb totalit t\u00eb tregut, nga 56% q\u00eb mbante nj\u00eb vit m\u00eb par\u00eb, nd\u00ebrsa One Albania ka zbritur n\u00eb 42% t\u00eb tregut, nga 44% q\u00eb zot\u00ebronte n\u00eb vitin 2023.<\/p>\n<p>Vodafone Albania dominon edhe n\u00eb volumin total t\u00eb thirrjeve, t\u00eb internetit dhe t\u00eb mesazheve t\u00eb shkruara, nd\u00ebrsa statistikat zyrtare tregojn\u00eb se dy kompanit\u00eb kan\u00eb pjes\u00eb tregu t\u00eb barabart\u00eb sipas numrit t\u00eb p\u00ebrdoruesve aktiv\u00eb.<\/p>\n<p>T\u00eb dh\u00ebnat e AKEP tregojn\u00eb se numri total i abonent\u00ebve celular\u00eb ose kartave SIM n\u00eb fund t\u00eb vitit 2024 arriti n\u00eb rreth 3.4 milion\u00eb, e th\u00ebn\u00eb ndryshe \u00e7do banor n\u00eb Shqip\u00ebri posedonte rreth 1.4 karta SIM, shif\u0451r kjo m\u0451 e lart\u0451 se mesatarja europiane prej 1.25 karta SIM p\u0451r banor\u0451. Kjo struktur\u00eb tregon nj\u00eb p\u00ebrqendrim t\u00eb lart\u00eb tregu dhe nj\u00eb nivel t\u00eb kufizuar konkurrence efektive, duke krijuar kushte t\u00eb favorshme p\u00ebr pozit\u00eb dominuese kolektive.<\/p>\n<p>Nga hetimi paraprak, q\u00eb p\u00ebrfshiu periudh\u00ebn nga 1 janari 2022 deri m\u00eb 25 korrik 2025, \u00ebsht\u00eb konstatuar se nd\u00ebrmarrjet Vodafone Albania dhe One Albania kan\u00eb ndjekur nj\u00eb sjellje t\u00eb ngjashme tregtare n\u00eb lidhje me ofertat e tyre t\u00eb sh\u00ebrbimeve celulare, p\u00ebrfshir\u00eb paketat me parapages\u00eb, me kontrat\u00eb dhe sh\u00ebrbimet roaming.<\/p>\n<p>N\u00eb k\u00ebt\u00eb periudh\u00eb, vihet re nj\u00eb rritje progresive dhe pothuajse e sinkronizuar e \u00e7mimeve,<\/p>\n<p>nd\u00ebrkoh\u00eb q\u00eb nuk rezulton q\u00eb k\u00ebto nd\u00ebrmarrje t\u00eb ken\u00eb p\u00ebrdorur nj\u00eb metodologji t\u00eb p\u00ebrllogaritjes s\u00eb<\/p>\n<p>kostove, q\u00eb do t\u00eb justifikonte ndryshimet e \u00e7mimeve t\u00eb aplikueshme n\u00eb treg.<\/p>\n<p>Nga analiza e zhvillimeve t\u00eb \u00e7mimeve rezulton se, sa her\u00eb nj\u00eb nga operator\u00ebt ka rritur \u00e7mimet e<\/p>\n<p>paketave celulare, operatori tjet\u00ebr e ka ndjekur brenda nj\u00eb periudhe t\u00eb shkurt\u00ebr kohore me nj\u00eb rritje t\u00eb ngjashme, si n\u00eb nivel \u00e7mimi, ashtu edhe n\u00eb struktur\u00ebn e paket\u00ebs (minuta, internet, SMS, vlefshm\u00ebri etj.).
